What is a DMCA Counter Notice?

  • A DMCA Counter Notice is submitted by the alleged infringer when they believe that the content being reported is not infringement.
  • The alleged infringer has the option submit a DMCA Counter Notice under penalty of perjury that they believe their product was wrongfully removed.
  • Once the website receives a counter notice they will then notify the person who originally submitted the takedown with the information provided in the counter notice.
  • In the rare occasion that a counter notice is issued, your next step will be to schedule a consult with an attorney. If it is proven that the counter notice was submitted in bad faith, you may be entitled to damages.

What does penalty of perjury mean?

  • Before you complete the DMCA Takedown process you agree to the following: I have a good faith belief that the material is not authorized by the intellectual property owner, its agent, or the law.
