Who is the Takedown Service for?

  • Our Takedown Service is for entrepreneurs who have had their intellectual property stolen and need help getting material that infringes on their small business taken down off of websites! Examples include: photos, videos, blog posts, website copy, social media copy, infringing website domain name, infringing social media usernames and so much more!

What is the Takedown Service?

  • The Legalpreneur will submit a DMCA Takedown (copyrights) or a Trademark Infringement Report (trademark) for you, the creator, to a service provider requesting the provider to remove material that is infringing on your intellectual property.
  • A service provider can be an internet service provider, website operator, search engine, a web host, or other type of online site-operator. Examples include: Etsy, Facebook, Instagram, Shopify, Amazon, etc

How does the Legalpreneur Takedown Service work? 

  • You will complete the checkout process and the Legalpreneur will collect the information we need to complete the Takedown Service for you.

Do I need a registration for the Legalpreneur to do a Takedown?

  • When it comes to copyrights... Absolutely not! Did you know that your content is protected the moment it is created? It is! Let infringers know that you are serious about protecting your creative work and get your copyright takedowns submitted today!
  • When it comes to trademarks... Yes, you must have a trademark registration for Legalpreneur to complete a Trademark Infringement Report . If you filed your trademark application with Andrea but have not received the official registration, contact hello@thelegalpreneur.com to learn more about alternative takedown options.

What is the difference between the Legalpreneur completing the takedown process for me versus an attorney?

  • The Legalpreneur charges $49 while attorneys charge $300+ for ONE takedown.
  • No attorney client relationship is established with the Legalpreneur. The Legalpreneur files your takedown as a third party for you.
  • The Legalpreneur will have your takedown filed within 1-2 business days.

What is a DMCA Counter Notice?

  • A DMCA Counter Notice is submitted by the alleged infringer when they believe that the content being reported is not infringement.
  • The alleged infringer has the option submit a DMCA Counter Notice under penalty of perjury that they believe their product was wrongfully removed.
  • Once the website receives a counter notice they will then notify the person who originally submitted the takedown with the information provided in the counter notice.
  • In the rare occasion that a counter notice is issued, your next step will be to schedule a consult with an attorney. If it is proven that the counter notice was submitted in bad faith, you may be entitled to damages.

What does penalty of perjury mean?

  • Before you complete the DMCA Takedown or the Trademark Infringement Report process you agree to the following: I have a good faith belief that the material is not authorized by the intellectual property owner, its agent, or the law. The information provided throughout the takedown process is accurate, and I swear under penalty of perjury that I am authorized to make the complaint on behalf of the intellectual property owner.
  • A takedown process is completed understanding that you will be found guilty of perjury if the facts declared in the process are shown to be materially false. In other words, don't file a takedown just because you don't like the person!
